Delhi High Court Rejects Request to Delay CA Exams Despite Clash with Lok Sabha Elections

The Delhi High Court has rejected a plea by CA aspirants seeking a postponement of exams due to clashes with the Lok Sabha elections. Despite initial concerns, the Institute of Chartered Accountants of India (ICAI) adjusted exam dates, emphasizing the importance of maintaining examination integrity amidst logistical challenges. The petition, filed by 27 aspirants, aimed to reschedule the exams in light of their clash with the upcoming Lok Sabha elections in 2024. However, the bench, led by Justice C. Harishankar, sternly rebuffed the plea, questioning the legality behind such a demand.

“Is there some law that says there can’t be any exams during Lok Sabha elections?” Justice C. Harishankar pointedly inquired, highlighting the absence of any legal grounds supporting the petitioners’ request. The aspirants had cited concerns over logistical issues, particularly transportation, arising from the scheduled dates coinciding with the electoral process. Nevertheless, the court maintained that the mere possibility of hardship for candidates cannot justify derailing an examination that approximately 4,26,000 aspirants are slated to undertake.

Expressing surprise at the nature of the request, the single bench emphasized that while elections are indeed scheduled for May 7 and 13, there are no exams slated for May 6 and 12, effectively mitigating any potential clash. The court’s firm stance underscored the importance of upholding the integrity of the examination process while acknowledging the logistical challenges posed by concurrent events.

The Institute of Chartered Accountants of India (ICAI) had previously announced revised dates for the CA exams in response to the Lok Sabha polls, albeit with no significant alterations to the examination schedule. The revised timetable, unveiled in March, saw adjustments to the dates of both the Inter and Final exams, ensuring minimal disruption amidst the electoral proceedings.

For the CA Inter examinations, Group 1 saw a shift from May 3, 5, and 7 to May 3, 5, and 9, while Group 2 was rescheduled from May 9, 11, and 13 to May 11, 15, and 17. Similarly, the CA Final exams witnessed adjustments, with Group 1 exams moved from May 2, 4, and 8 to May 2, 4, and 8, and Group 2 exams rescheduled from May 8, 10, and 12 to May 10, 14, and 16. Additionally, the International Taxation — Assessment Test (INTT-AT) exams were slated for May 14 and 16, accommodating the revised schedule.

Despite initial concerns raised by aspirants regarding logistical challenges and the overlap with the Lok Sabha elections, the ICAI’s proactive measures in adjusting the exam dates have sought to alleviate any potential conflicts. The revised timetable reflects a concerted effort to uphold the integrity of the examination process while mitigating disruptions for candidates.

As aspirants gear up to tackle the rigorous CA examinations, the Delhi High Court’s dismissal of the plea serves as a reaffirmation of the importance of adhering to established schedules and protocols. While logistical challenges may arise amidst concurrent events such as elections, the commitment to maintaining the integrity and fairness of examinations remains paramount.
